Three years after the Unified Patent Court opened its doors, the unitary patent system is taking shape in practice. This article looks at how the new options are used, where opt-outs are declining, and what the first wave of UPC activity reveals about Europe’s evolving patent landscape.

The current IP framework remains fundamentally human-centered. While AI may assist in creating inventions and content, legal ownership generally depends on identifiable human contributions. Organizations that clearly document those contributions and align their IP strategies with existing legal requirements will be best positioned to protect and commercialize AI-assisted innovations.

Uit Europees onderzoek blijkt dat ruim 90% van de ondernemers geen geregistreerde intellectuele eigendomsrechten heeft. Daarom lanceerden vijf Belgische en Nederlandse overheidsorganisaties op 26 april 2022 - Werelddag van de intellectuele eigendom - voor het eerst een nieuw gemeenschappelijk digitaal platform voor intellectuele eigendomsrechten.
